The government has made it mandatory for employers to pay the salary of their staffers through banking channel.
The Cabinet, on Sunday, passed the ‘Labour Bylaw 2018′, which has stated that ‘all kinds of employment agencies, companies or individuals engaged in any sector have to compulsorily pay the salary of their staffers through banking system’.
“The Ministry of Labour, Employment and Social Security (MoLESS) had submitted the final draft of the bylaw to the Cabinet on Sunday, which was subsequentyly approved,” informed Minister for Labour, Employment and Social Security Gokarna Bista.
The bylaw has come into effect from Sunday itself.
“The MoLESS is preparing to make directives within a month for effective implementation of the bylaw,” Bista stated.
According to the bylaw, any company or individual hiring any number of full-time or part-time workers is required to submit updated records related to the staffers’ type of employment, designation, work station, the date of the agreement coming into effect, and other details to the Department of Labour (DoL).
Moreover, the bylaw has made it compulsory for the employer to assign the designation and pay the salary to the employee as mentioned in the employment contract. Likewise, every staffer is entitled to a paid weekly day off, as per the bylaw.
The bylaw has urged employers to hire Nepali staffers over foreign labour.
According to the bylaw, an employer must contribute to the social security fund of the employee according to Social Security Act, 2017.
The bylaw has stated that the employer must formulate an internal law to compensate the staffers up to a certain amount for treatment of diseases or in case of accidents.
As per the bylaw, the employer cannot ask a male employee to lift weights of more than 55 kilograms and more than 45 kilograms for female employees.
Also, the employer must conduct labour audit as per the criteria set by MoLESS guideline every year.
The bylaw has also categorised domestic help as ‘labourer’. Apart from weekly off, they are now also entitled to 12-day paid leave every year like the workers engaged in industrial, commercial and construction sectors.
